Alle persoonsgegevens die Hi-T BV, met zetel te 2660 Antwerpen, Boombekelaan 7 en ingeschreven in de Kruispuntbank van Ondernemingen onder het nummer 0742.521.043 (telefoonnummer: 03 361 46 79, e-mailadres: hello@hi-t.pro) (hierna “Hi-T”) van u ontvangt als (contactpersoon van een) betrokkene worden verwerkt in overeenstemming met de toepasselijke regelgeving inzake gegevensbescherming, in het bijzonder de Algemene Verordening Gegevensbescherming 2016/679 van 27 april 2016 (“AVG”), evenals deze privacyverklaring.

In geval u vragen heeft over de verwerking van uw persoonsgegevens, kan u steeds contact opnemen met de verwerkingsverantwoordelijke, zijnde Hi-T.

Artikel 1 Toepassingsgebied

Huidige privacyverklaring is van toepassing op alle activiteiten in het kader van de bedrijfsvoering van Hi-T, waaronder maar niet beperkt tot de diensten die door Hi-T worden verstrekt, de overeenkomsten die door Hi-T worden aangegaan met een (contactpersoon van een) betrokkene, de communicatie die wordt gevoerd met een (contactpersoon van een) betrokkene en dergelijke meer.

Artikel 2 Verwerking van persoonsgegevens van betrokkenen en doeleinden

2.1 Personeel en sollicitanten

2.1.1 Persoonsgegevens

Onder meer volgende persoonsgegevens van personeelsleden en sollicitanten kunnen worden verwerkt door Hi-T:

Aanspreektitel, voornaam en naam;
(bedrijfs)adres;
E-mailadres;
Telefoonnummer;
Identiteitskaartnummer en rijksregisternummer;
Rijbewijsnummer;
Pensioennummer;
Limosanummer;
Persoonlijke kenmerken (waaronder maar niet beperkt tot geslacht, geboortedatum, geboorteplaats, taal, nationaliteit, burgerlijke staat);
Financiële gegevens (bankrekeningnummer, beslagberichten);
CV (inclusief loopbaangegevens zoals diploma’s, technische vaardigheden en andere kwalificaties, informatie over persoonlijke ontwikkeling en evaluaties, met inbegrip van referenties);
Strafrechtelijke gegevens zoals verkeersovertredingen en eventuele andere veroordelingen;
Foto’s;
Bepaalde informatie gelieerd aan de toepasselijke arbeidsrechtelijke wettelijke verplichtingen;
Alle andere persoonsgegevens die de betrokkene aan Hi-T verstrekt of door de bevoegde instanties worden opgevraagd.

2.1.2 Verwerkingsdoeleinden

De persoonsgegevens van de betrokkenen bedoeld in dit artikel 2.1 kunnen verwerkt worden met als doel: (i) de bedrijfsvoering van Hi-T, (ii) de uitvoering van de overeenkomst(en) afgesloten met Hi-T, waaronder maar niet beperkt tot:

Personeelsadministratie;
Voldoen aan sociale en fiscale wetgeving;
Beheer van competenties en opleidingen van personeel;
Beheer van persoonlijke ontwikkeling en evaluatie van medewerkers;
Specifieke vereisten in het kader van de uitvoering van overeenkomsten met het cliënteel en leveranciers van Hi-T.

De toepasselijke rechtsgronden voor deze verwerking zijn de uitvoering van de overeenkomst, het vervullen van wettelijke en reglementaire verplichtingen en het gerechtvaardigd belang van Hi-T.

2.2 Klanten

2.2.1 Persoonsgegevens

Onder meer volgende persoonsgegevens van (contactpersonen van) klanten kunnen worden verwerkt door Hi-T:

Aanspreektitel, voornaam en naam;
(bedrijfs)adres;
E-mailadres;
Ondernemingsnummer;
Telefoonnummer;
Functie;
Financiële gegevens (bankrekeningnummer, beslagberichten, wijze van betaling);
Alle andere persoonsgegevens die de betrokkene aan Hi-T verstrekt.

2.2.2 Verwerkingsdoeleinden

De persoonsgegevens van de betrokkenen bedoeld in dit artikel 2.2 kunnen verwerkt worden met als doel: (i) de bedrijfsvoering van Hi-T, (ii) de uitvoering van de overeenkomst(en) afgesloten met Hi-T, waaronder maar niet beperkt tot:

Dienstverlening aan de klanten;
Optimalisering van de dienstverlening;
Klantenbeheer en -administratie;
Facturatie en voeren van de boekhouding;
Voldoen aan sociale en fiscale wetgeving;
Nakijken van solvabiliteit;
Marketingactiviteiten, waaronder maar niet beperkt tot nieuwsbrieven en andere commerciële communicaties;
Geschillenbeheer.

De toepasselijke rechtsgronden voor deze verwerking zijn de uitvoering van de overeenkomst, het vervullen van wettelijke en reglementaire verplichtingen en het gerechtvaardigd belang van Hi-T.

2.3 Leveranciers, dienstverleners en onderaannemers

2.3.1 Persoonsgegevens

Onder meer volgende persoonsgegevens van (contactpersonen van) leveranciers, dienstverleners, onderaannemers en hun personeel, medewerkers, aangestelden en andere nuttige contactpersonen kunnen worden verwerkt door Hi-T:

Aanspreektitel, voornaam en naam;
(bedrijfs)adres;
E-mailadres;
Telefoonnummer;
Persoonlijke kenmerken (waaronder maar niet beperkt tot geslacht, geboortedatum, geboorteplaats, taal, nationaliteit, burgerlijke staat, familiale gegevens);
Financiële gegevens (bankrekeningnummer, beslagberichten);
Alle andere persoonsgegevens die de betrokkene aan Hi-T verstrekt of door de bevoegde instanties worden opgevraagd.

2.3.2 Verwerkingsdoeleinden

De persoonsgegevens van de betrokkenen bedoeld in dit artikel 2.3 kunnen verwerkt worden met als doel: (i) de bedrijfsvoering van Hi-T, (ii) de uitvoering van de overeenkomst(en) afgesloten met Hi-T, waaronder maar niet beperkt tot:

Leverancierbeheer en -administratie;
Facturatie en voeren van de boekhouding;
Voldoen aan sociale en fiscale wetgeving;
Nakijken van solvabiliteit;
Marketingactiviteiten, waaronder maar niet beperkt tot nieuwsbrieven en andere commerciële communicaties;
Specifieke vereisten in het kader van de uitvoering van overeenkomsten met het cliënteel en leveranciers van Hi-T;
Geschillenbeheer.

De toepasselijke rechtsgronden voor deze verwerking zijn de uitvoering van de overeenkomst, het vervullen van wettelijke en reglementaire verplichtingen en het gerechtvaardigd belang van Hi-T.

2.4 Gebruik website, social media of door middel van enig ander communicatiekanaal

2.4.1 Persoonsgegevens

Onder meer volgende persoonsgegevens kunnen worden verwerkt door Hi-T wanneer een betrokkene gebruik maakt van de website en waar relevant het daarop beschikbaar platform, social media of enig ander communicatiekanaal (waaronder maar niet beperkt tot e-mail of telefoon):

Aanspreektitel, voornaam en naam;
(bedrijfs)adres;
E-mailadres;
Telefoonnummer;
Functie;
IP-adres, browsertype, geografische locatie, besturingssysteem en andere technische informatie in verband met het toestel dat door de betrokkene wordt gebruikt;
Hoe lang de betrokkene surft, welke links de betrokkene aanklikt, welke webpagina’s de betrokkene bezoekt, alsook hoe vaak de betrokkene deze bezoekt;
Gebruikersnaam en wachtwoorden;
Alle andere persoonsgegevens die de betrokkene aan Hi-T verstrekt.

2.4.2 Verwerkingsdoeleinden

De persoonsgegevens van de betrokkenen bedoeld in dit artikel 2.4 kunnen verwerkt worden met als doel: (i) de bedrijfsvoering van Hi-T, (ii) de uitvoering van de overeenkomst(en) afgesloten met Hi-T, waaronder maar niet beperkt tot:

Facturatie en voeren van de boekhouding;
Voldoen aan sociale en fiscale wetgeving;
Nakijken van solvabiliteit;
Marketingactiviteiten, waaronder maar niet beperkt tot nieuwsbrieven en andere commerciële communicaties;
Het verbeteren en optimaliseren van de veiligheid, inhoud en ervaring op website en sociale mediapagina’s;
Het detecteren en voorkomen van malware en andere vormen van misbruik;
Geschillenbeheer.

De toepasselijke rechtsgronden voor deze verwerking zijn de uitvoering van de overeenkomst, het vervullen van wettelijke en reglementaire verplichtingen en het gerechtvaardigd belang van Hi-T.

2.5 Overige verwerking van gegevens

2.5.1 Naast de gegevens vermeld in artikels 2.1 tot en met 2.4, verzamelt en verwerkt Hi-T ook persoonsgegevens van potentiële klanten, prospecten, nuttige contacten, contacten van netwerkevents, contacten van deskundigen en dergelijke meer.

2.5.2 De persoonsgegevens van de betrokkenen bedoeld in dit artikel 2.5 kunnen verwerkt worden met het oog op marketing doeleinden in het belang van de activiteiten van Hi-T.

2.5.3 De toepasselijke rechtsgronden voor deze verwerking zijn het gerechtvaardigd belang van Hi-T en desgevallend de uitvoering van de overeenkomst.

2.6 Marketingactiviteiten per e-mail

2.6.1 Door het verstrekken van een e-mailadres aan Hi-T verleent betrokkene de toestemming dat Hi-T hem/haar per e-mail mag contacteren voor marketingdoeleinden.

2.6.2 Betrokkene kan deze toestemming op ieder ogenblik intrekken en aangeven dat hij/zij geen verdere marketingcommunicatie per e-mail wenst te ontvangen.

Artikel 3 Duur van de verwerking

3.1 Hi-T verwerkt en bewaart de persoonsgegevens zo lang als nodig voor de doeleinden van de verwerking ervan, de wettelijke verplichtingen daaromtrent en in functie van de desgevallend bestaande contractuele relatie. Na het verstrijken van deze periode, zal Hi-T deze gegevens op een veilige manier definitief verwijderen.

3.2 De persoonsgegevens die Hi-T via de website of sociale media pagina’s verwerkt, bewaart zij maximaal één (1) jaar.

Artikel 4 Beveiliging

4.1 Hi-T heeft passende technische en organisatorische maatregelen geïmplementeerd om de vertrouwelijkheid van uw persoonsgegevens te waarborgen en uw gegevens te beschermen tegen onopzettelijke of onwettige vernietiging, verlies, wijziging, ongeautoriseerde openbaarmaking of toegang.

4.2 Hi-T deelt steeds het strikte minimum aan persoonsgegevens dat noodzakelijk is voor de betreffende verwerking en hanteert een selectief beleid inzake het delen van persoonsgegevens met derden buiten de Europese Economische Ruimte.

Artikel 5 Rechten

5.1 U kan Hi-T altijd contacteren op de communicatiekanalen vermeld in de hoofding van de privacyverklaring, voor de uitoefening van de volgende rechten:

een verzoek om inzage of rectificatie van uw persoonsgegevens;
een verzoek om wissing van uw persoonsgegevens;
een verzoek om beperking van de verwerking van uw persoonsgegevens;
een bezwaar tegen de verwerking van uw gegevens;
een verzoek om uw toestemming in te trekken;
een verzet tegen volledig geautomatiseerde individuele besluitvorming zonder enige menselijke tussenkomst die u in aanmerkelijke mate treft; en
een klacht als u van mening bent dat Hi-T niet handelt in overeenstemming met de toepasselijke wetgeving inzake gegevensbescherming. U kan ook een klacht indienen bij de Belgische Gegevensbeschermingsautoriteit.

5.2 Voor de doeleinden waarvoor de rechtsgrond voor de verwerking van persoonsgegevens een gerechtvaardigd belang is, kan u Hi-T steeds meer informatie vragen over de belangenafweging die in dat kader werd uitgevoerd.

5.3 Voor die doeleinden waarvoor de rechtsgrond voor de verwerking van persoonsgegevens een taak van algemeen belang of gerechtvaardigd belang is, kan u te allen tijde uw recht op bezwaar uitoefenen tegen de verwerking van uw persoonsgegevens, met vermelding van de redenen die op uw specifieke situatie betrekking hebben. Hi-T zal de verwerking van uw persoonsgegevens staken tenzij zij van oordeel is dat er dwingende gerechtvaardigde gronden zijn die zwaarder wegen dan de belangen, rechten en vrijheden die u aanvoert.

5.4 Om uw verzoeken correct te kunnen opvolgen en te beantwoorden, verwerkt Hi-T uw persoonsgegevens op basis van haar wettelijke verplichtingen die voortvloeien uit hoofdstuk III juncto art. 5.2 AVG (art. 6.1, c) AVG).

5.5 Hi-T kan u vragen uw verzoek te motiveren en/of een bewijs van identiteit te bezorgen, bijv. een kopie van de voorzijde van uw identiteitskaart.

Artikel 6 Verwerkers en doorgiften aan derden

6.1 De betrokkene erkent en stemt er expliciet mee in dat Hi-T persoonsgegevens mag doorgeven aan derden subverwerkers (waaronder maar niet beperkt tot eigen software-leveranciers, boekhouders, juridische adviseurs, verzekeraars, revisoren, de overheid of andere actoren in het kader van de naleving van wettelijke verplichtingen) in het kader van het toepassingsgebied als gedefinieerd in Artikel 1.

6.2 Elke dergelijke subverwerker aan wie Hi-T persoonsgegevens doorgeeft zal alleen persoonsgegevens mogen verkrijgen om de diensten te verstrekken die Hi-T eraan heeft toevertrouwd en zal dergelijke persoonsgegevens voor geen andere doeleinden mogen gebruiken.

6.3 Hi-T mag de gegevens ook aan derden bekendmaken in de volgende gevallen:

Om in overeenstemming te zijn met de toepasselijke wetgeving of regelgeving;
Indien een toezichthoudende autoriteit of een andere overheidsinstantie dit officieel verzoekt;
Voor het onderzoek naar verdachte of werkelijk frauduleuze of illegale activiteiten;
Om de veiligheid en/of de rechten van betrokkenen of van Hi-T te beschermen.

Artikel 7 Technische en organisatorische maatregelen

Rekening houdend met de stand van de techniek, de uitvoeringskosten en de aard, omvang, context en het doel van de verwerking van de persoonsgegevens alsmede met de qua waarschijnlijkheid en ernst uiteenlopende risico’s voor de rechten en vrijheden van natuurlijke personen die aan de verwerking zijn verbonden, neemt Hi-T passende technische en organisatorische maatregelen om de persoonsgegevens die worden verwerkt ten dienste van de betrokkenen te beveiligen en beveiligd te houden.

Artikel 8 Meldplicht datalekken

8.1 Hi-T zal de betrokkene zo spoedig mogelijk informeren over inbreuken op haar beveiliging die moeten worden gemeld aan de Belgische Gegevensbeschermingsautoriteit en/of de betrokkene(n).

8.2 Op verzoek van de betrokkene zal Hi-T in het geval van een inbreuk hem in ieder geval de volgende informatie verstrekken:

(1) de aard van de inbreuk en van de getroffen persoonsgegevens;
(2) de waarschijnlijke gevolgen van de inbreuk;
(3) de maatregelen die in dat verband worden of zijn getroffen.

8.3 Indien het voor Hi-T niet mogelijk is om deze informatie direct te verstrekken, dan zal zij dat in stappen doen.

8.4 Hi-T zal alle noodzakelijke medewerking verlenen aan het zo nodig verschaffen van aanvullende informatie aan de toezichthouder(s) en/of betrokkene(n).

8.5 Hi-T houdt een overzicht bij van de feiten en gevolgen van de inbreuken op de beveiliging.

Artikel 9 Updates

Deze privacyverklaring kan van tijd tot tijd worden gewijzigd, binnen de beperkingen van de toepasselijke regelgeving inzake gegevensbescherming. Na doorvoering van wijzigingen zal de gewijzigde versie u onverwijld worden overgemaakt.

All personal data collected by Hi-T BV, with its registered office at Boombekelaan 7, 2660 Antwerp, and registered in the Crossroads Bank for Enterprises under number 0742.521.043 (phone number: 03 361 46 79, email address: hello@hi-t.pro) (hereinafter “Hi-T”) as data subjects (or contact persons of data subjects) will be processed in accordance with applicable data protection regulations, in particular the General Data Protection Regulation 2016/679 of April 27, 2016 (“GDPR”), as well as this privacy policy.

If you have any questions regarding the processing of your personal data, you may always contact the data controller, namely Hi-T.

Article 1 Scope

This privacy statement applies to all activities within the scope of Hi-T’s business operations, including but not limited to the services provided by Hi-T, the agreements entered into by Hi-T with a data subject (or a contact person of a data subject), the communications conducted with a data subject (or a contact person of a data subject), and similar matters.

If there is a discrepancy or ambiguity between the content of the English version of the Privacy Policy and the Dutch version, the Dutch version shall prevail.

Article 2 Processing of personal data of data subjects and purposes

2.1 Employees and job applicants

2.1.1 Personal Data

Hi-T may process the following personal data of employees and job applicants, among others:

Title, first name, and last name;
(Business) address;
Email address;
Phone number;
ID card number and national registration number;
Driver’s license number;
Pension number;
Social Security number;
Personal characteristics (including but not limited to gender, date of birth, place of birth, language, nationality, marital status);
Financial data (bank account number, garnishment notices);
Resume (including career details such as degrees, technical skills, and other qualifications, information on personal development and evaluations, including references);
Criminal records, such as traffic violations and any other convictions;
Photos;
Certain information related to applicable labor law obligations;
All other personal data provided by the data subject to Hi-T or requested by the competent authorities.

2.1.2 Purposes of Processing

The personal data of the data subjects referred to in this article 2.1 may be processed for the following purposes: (i) the business operations of Hi-T, (ii) the performance of the agreement(s) entered into with Hi-T, including but not limited to:

Personnel administration;
Compliance with social and tax legislation;
Management of staff competencies and training;
Management of employee personal development and evaluation;
Specific requirements in the context of the performance of agreements with Hi-T’s clients and suppliers.

The applicable legal grounds for this processing are the performance of the agreement, compliance with legal and regulatory obligations, and Hi-T’s legitimate interest.

2.2 Customers

2.2.1 Personal Data

Hi-T may process the following personal data of (contact persons for) customers, among other things:

Title, first name, and last name;
(Business) address;
Email address;
Enterprise and VAT number;
Phone number;
Job title;
Financial information (bank account number, attachment notices, payment method);
Any other personal data that the data subject provides to Hi-T.

2.2.2 Purposes of Processing

The personal data of the data subjects referred to in this article 2.2 may be processed for the following purposes: (i) the day-to-day operations of Hi-T, (ii) the performance of the agreement(s) entered into with Hi-T, including but not limited to:

Providing services to customers;
Optimizing service provision;
Customer management and administration;
Invoicing and bookkeeping;
Compliance with social and tax legislation;
Checking creditworthiness;
Marketing activities, including but not limited to newsletters and other commercial communications;
Dispute resolution.

The applicable legal grounds for this processing are the performance of the agreement, compliance with legal and regulatory obligations, and the legitimate interest of Hi-T.

2.3 Suppliers, service providers, and subcontractors

2.3.1 Personal Data

The following personal data of (contact persons of) suppliers, service providers, subcontractors, and their staff, employees, appointees, and other relevant contact persons may be processed by Hi-T:

Title, first name, and last name;
(Business) address;
Email address;
Phone number;
Personal characteristics (including but not limited to gender, date of birth, place of birth, language, nationality, marital status, family details);
Financial information (bank account number, garnishment notices);
All other personal data provided by the data subject to Hi-T or requested by the competent authorities.

2.3.2 Purposes of Processing

The personal data of the data subjects referred to in this article 2.3 may be processed for the following purposes: (i) the business operations of Hi-T, (ii) the performance of the agreement(s) entered into with Hi-T, including but not limited to:

Supplier management and administration;
Invoicing and bookkeeping;
Compliance with social and tax legislation;
Checking creditworthiness;
Marketing activities, including but not limited to newsletters and other commercial communications;
Specific requirements in connection with the performance of agreements with Hi-T’s clients and suppliers;
Dispute resolution.

The applicable legal grounds for this processing are the performance of the agreement, compliance with legal and regulatory obligations, and Hi-T’s legitimate interest.

2.4 Use of the website, social media, or any other communication channel

2.4.1 Personal Data

The following personal data, among others, may be processed by Hi-T when a data subject uses the website and, where relevant, the platform available thereon, social media, or any other communication channel (including but not limited to email or telephone):

Title, first name, and last name;
(Business) address;
Email address;
Phone number;
Job title;
IP address, browser type, geographic location, operating system, and other technical information related to the device used by the data subject;
How long the data subject browses, which links the data subject clicks on, which web pages the data subject visits, as well as how often the data subject visits them;
Username and passwords;
Any other personal data that the data subject provides to Hi-T.

2.4.2 Purposes of Processing

The personal data of the data subjects referred to in this article 2.4 may be processed for the following purposes: (i) the business operations of Hi-T, (ii) the performance of the agreement(s) entered into with Hi-T, including but not limited to:

Invoicing and bookkeeping;
Compliance with social and tax legislation;
Checking creditworthiness;
Marketing activities, including but not limited to newsletters and other commercial communications;
Improving and optimizing the security, content, and experience on the website and social media pages;
Detecting and preventing malware and other forms of abuse;
Dispute resolution.

The applicable legal grounds for this processing are the performance of the agreement, compliance with legal and regulatory obligations, and the legitimate interests of Hi-T.

2.5 Other Data Processing

2.5.1 In addition to the data mentioned in articles 2.1 through 2.4, Hi-T also collects and processes personal data from potential customers, prospects, useful contacts, contacts from networking events, expert contacts, and the like.

2.5.2 The personal data of the data subjects referred to in this article 2.5 may be processed for marketing purposes in the interest of Hi-T’s activities.

2.5.3 The applicable legal grounds for this processing are Hi-T’s legitimate interest and, where applicable, the performance of the agreement.

2.6 Marketing Activities via Email

2.6.1 By providing an email address to Hi-T, the data subject grants consent for Hi-T to contact the data subject via email for marketing purposes.

2.6.2 The data subject may withdraw this consent at any time and indicate that the data subject does not wish to receive further marketing communications via email.

Article 3 Duration of processing

3.1 Hi-T processes and retains personal data for as long as necessary for the purposes of processing, to comply with applicable legal obligations, and in accordance with any existing contractual relationship. Upon expiration of this period, Hi-T will permanently delete this data in a secure manner.

3.2 Hi-T retains the personal data it processes via the website or social media pages for a maximum of one (1) year.

Article 4 Security

4.1 Hi-T has implemented appropriate technical and organizational measures to ensure the confidentiality of your personal data and to protect your data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access.

4.2 Hi-T always shares only the strict minimum of personal data necessary for the relevant processing and maintains a selective policy regarding the sharing of personal data with third parties outside the European Economic Area.

Article 5 Rights

5.1 You may always contact Hi-T via the communication channels listed in the header of this privacy statement to exercise the following rights:

a request to access or rectify your personal data;
a request to erase your personal data;
a request to restrict the processing of your personal data;
an objection to the processing of your personal data;
a request to withdraw your consent;
a request not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you;
a request for the portability of your personal data; and
a complaint if you believe that Hi-T is not acting in accordance with applicable data protection laws. You may also file a complaint with the Belgian Data Protection Authority (Gegevensbeschermingsautoriteit).

5.2 For purposes where the legal basis for the processing of personal data is a legitimate interest, you may always ask Hi-T for more information about the balancing of interests carried out in that context.

5.3 For those purposes where the legal basis for the processing of personal data is a task carried out in the public interest or a legitimate interest, you may at any time exercise your right to object to the processing of your personal data, stating the reasons relating to your specific situation. Hi-T will cease processing your personal data unless it determines that there are compelling legitimate grounds that outweigh the interests, rights, and freedoms you have invoked.

5.4 In order to properly process and respond to your requests, Hi-T processes your personal data based on its legal obligations arising from Chapter III in conjunction with Article 5.2 of the GDPR (Article 6.1(c) of the GDPR).

5.5 Hi-T may ask you to provide a justification for your request and/or proof of identity, e.g., a copy of the front of your ID card.

Article 6 Processors and transfers to third parties

6.1 The data subject acknowledges and explicitly consents to Hi-T transferring personal data to third-party subprocessors (including but not limited to its own software suppliers, accountants, legal advisors, insurers, auditors, government agencies, or other entities in the context of compliance with legal obligations) within the scope of application as defined in Article 1.

6.2 Any such subprocessor to whom Hi-T transfers personal data shall only be permitted to obtain personal data for the purpose of providing the services entrusted to it by Hi-T and shall not be permitted to use such personal data for any other purposes.

6.3 Hi-T may also disclose the data to third parties in the following cases:

To comply with applicable laws or regulations;
If a regulatory authority or other government agency officially requests it;
For the investigation of suspected or actual fraudulent or illegal activities;
To protect the safety and/or rights of data subjects or of Hi-T.

Article 7 Technical and organizational measures

Taking into account the technical evolution, the costs of implementation, and the nature, scope, context, and purpose of the processing of personal data, as well as the varying likelihood and severity of the risks to the rights and freedoms of natural persons associated with the processing, Hi-T takes appropriate technical and organizational measures to secure and keep secure the personal data being processed on behalf of the data subjects.

Article 8 Data breach notification obligation

8.1 Hi-T will inform the data subject as soon as possible of any security breaches that must be reported to the Belgian Data Protection Authority and/or the data subject(s).

8.2 At the data subject’s request, Hi-T will, in the event of a breach, provide the data subject with at least the following information:

(1) the nature of the breach and of the personal data affected;
(2) the likely consequences of the breach;
(3) the measures being taken or that have been taken in this regard.

8.3 If Hi-T is unable to provide this information immediately, it will do so in stages.

8.4 Hi-T will provide all necessary cooperation to supply additional information to the supervisory authority(ies) and/or data subject(s) as needed.

8.5 Hi-T maintains a record of the facts and consequences of security breaches.

Article 9 Updates

This privacy statement may be amended from time to time, within the limits of applicable data protection regulations. Once changes have been implemented, the amended version will be provided to you without delay.
